TERMS OF USE

1.0 Parties to Agreement

1.1 Party A

Guests4Dinner Pty Ltd, is an Australian Proprietary Limited registered company, trading as Guests4Dinner.com®

1.2 Party B

is a Host Provider (seller) of dinners and other experiences to invited ‘Guests’ (as buyers) who are introduced to Host Party B via use of Party A’s Guests4Dinner.com® Service Communication

Platform.

2.0 Basis of Agreement

2.1 Party A provides a Communication Service Platform that provides the means to connect

registered invited ‘Guests’ (as buyers) with a Registered Host (Party B as a seller).

2.2 Party B fully understands that Party A will be paid for its Communication Platform, Payment

system and services provided based on a percentage of end sale values.

2.3 Party A expresses no service warranty or guarantee that invited Guests (as buyers) will or will not utilise the services of Party B.

2.4 Party B understands and makes no claims in relation to the Registered Trademark

Guests4Dinner.com® and Domain names guests4dinner.com and guests4dinner.com.au, such intellectual property being 100% entirely owned by Party A.

2.5 Party B Hosts fully understand and agree that this Agreement does not represent any

Employment contract or other such contractual arrangement between Party A Guests4Dinner Pty Ltd and Party B as a Host Provider.

2.6 Party B fully understands and agrees that ALL Home Cook, Chef Hosts and Organisers are

deemed to be independent sellers of their hosting service and are responsible for their own

Accounting, Financial and Taxation affairs. Where appropriate, they should seek their own Financial and Taxation advice.

2.7 Party B as a Host (being a Home Cook, Organiser or Chef) understands and agrees to register on the Guests4Dinner.com service platform. This is both to authenticate the true identity of Home Cooks, Chefs and Organisers and for Guests4Dinner Pty Ltd to have a record of all transactions and interactions that occur via the Guests4Dinner.com® service platform.

2.8 Party B understands that All Home Cooks, Chefs and Organisers should have Home and Contents or Contents Insurance that covers loss, theft and accidental or malicious damage to Property and that Party B is responsible for this.

2.9 Party B understands that is also advisable to have Public Liability Insurance – that covers any and all trade people, children, friends, neighbours or invited guests coming into Host’s home or venue in the advent that a Guest may fall over or injure themselves in some way. Home Cooks, Chef Hosts and Organisers are solely responsible for this.

2.10 All Guests4Dinner.com® ‘Guests’ and ‘Friends’ are by invitation only via the Guests4Dinner Service Platform.

2.11 All Guests4Dinner.com® ‘Home Hosts’ thoroughly cook food for immediate consumption and do not provide meals to the General Public, nor do they provide a Delivery Service for meals.

2.12 All Professional ‘Chef Hosts’ may operate a Restaurant, Café, Food Truck or Commercial Kitchen and must comply with all State Food Authority and Local Council Regulations.

2.13 Party B understands and agrees that it is the responsibility of the Home Cooks, Chef Hosts and Organisers to manage the health, hygiene and cleanliness of their kitchen and all food preparation, food and drinks served and, serving utensils, as well as the hygiene and cleanliness of all bathrooms that might be used by invited Guests while in their home, restaurant or other venue. Party A Guests4Dinner Pty Ltd takes no responsibility for maintaining these standards, but reserves the rights to de-list any Home Cook or Chef Hosts that fail to meet good hygiene and cleaning standards, and where a number of Guests register complaints, Guests4Dinner reserves the right to cancel Party B’s Host Registration.

3.0 SIGNATURE TO AGREEMENT

In signing this Agreement as a Host – this represents full acceptance of all Terms of Use for using the Guests4Dinner.com® Service Platform.

PRIVACY POLICY

Guests4Dinner Pty Ltd is the Australian Company that owns and operates the Communication

Service Platform, Guests4Dinner.com® connecting invited pre-paying Guests with Host service providers.

The Guests4Dinner.com® service platform provides Service information and the Financial Payment system to enable host provider services and financial payment and purchase transactions to occur.

In order to facilitate such service and payments, Guests4Dinner Pty Ltd through its Communication Service Platform collects personal information and data including names, email addresses, mobile phone numbers, as well addresses of both invited Paying Guests and Host providers. It also collects and records Banking details for payments from invited Guests and to Hosts using Stripe as its secure Payment System.

Such information and Data is used for the purpose of conducting the guests4dinner.com online business, with full contact details of invited Guests and Hosts only provided to the two parties once a Guest Booking has been made.

Guests4Dinner securely stores and records all personal and financial Information and transactions and uses Stripe software to accept payments and manage the Guests4Dinner.com® business on-line.
